Chapter 13 Bankruptcy differs from Chapter 7 Bankruptcy because it usually requires the debtor to repay all of, or a portion, of their debts. This requires you and your attorney to propose a payment plan that must be accepted by the United States Trustee. The plan is going to require the debtor to repay some, or all of, their debts over a 3-5 year period. Chapter 13 Bankruptcy is usually best for those people that might have an income that is too high to qualify for a Chapter 7. One of the keys to a Chapter 13 is being certain that your income is sufficient to maintain all your current payments in addition to the payment created by your Chapter 13 plan. Failing to stay current or failing to pay your Chapter 13 plan can cause your bankruptcy to be almost immediately dismissed.
